The victims of medical malpractice range from improperly delivered babies with brain damage to adults who have been treated with unnecessary and damaging medical procedures. Medical malpractice cases are among the most difficult of all lawsuits.
Over the years, the medical insurance industry and the health care lobby have pressured the courts and legislature to change the law so that doctors and hospitals have an unfair advantage over other litigants. For example, in any other type of case the time within which an injured infant can bring a lawsuit is tolled (stayed) for 18 years so that the infant has a chance to become mature enough to understand what has happened to him. However, when a doctor or hospital commits malpractice on a baby, the baby only has 10 years to realize that he may be able to bring a lawsuit. In other words, when a doctor or hospital is involved, the law assumes that a 10 year-old is mature enough to know his legal rights.
